Petitioner is employed as Assistant Teacher in Junior High School, Jaitpur, Shivali, Block Maitha, Kanpur Dehat.  It is stated that he is handicapped to the extent of 60% and in support thereto he has enclosed the medical certificate issued by the Chief Medical Officer, Kanpur Dehat.  It is further stated that the wife of the petitioner is also working in a Primary School situate in the same campus.  The petitioner is aggrieved by an order of transfer dated 7.7.2006 issued by the Zila Basic Shiksha Adhikari, Kanpur Dehat, whereunder the petitioner has been transferred from Jaitpur to Laxmanpur Rasoola which is a different Vikas Khand. Hence the present writ petition.

Having regard to the facts and circumstances of the case it would be fair that the petitioner may asked to make a representation ventilating all his grievances before the Basic Shiksha Adhikari supported by such documents as he may be advised against the order of transfer, within two weeks from today along with a certified copy of this order.

On such a representation being made Basic Shiksha Adhikari shall consider and decide the same in accordance with the Government order/Rules applicable and shall pass a reasoned speaking order, preferably within four weeks, thereafter.

For a period of six weeks status quo with regards to the place of working of the petitioner shall be maintained.

Writ petition stands disposed of.
