Issue notice.

The Standing Counsel has accepted notice on behalf of the respondent nos.1 to 4.  In addition of normal mode of service the petitioner is permitted to serve respondent no.5 personally and file an affidavit of service within ten days. Office is directed to hand over dasti notice to the petitioner within three days.  The notice shall indicate that the case is listed for admission on 7th August, 2006.

All the respondents may file counter affidavit by 3rd August, 2006. Rejoinder affidavit, if any, may be filed on or before the date fixed.

List on 7th August, 2006.

As an interim measure it is provided that further proceedings pending before the District Excise Officer, Banda pursuant to the order dated 28th June, 2006, if the same has not already been decided, shall remain stayed.
