Heard learned counsel for the applicant and learned A.G.A.

This application is filed by  applicant  Surendra Kumar Sharma with a prayer to quash the proceedings of case crime No. 285 of 2002, under Sections 17, 15(2) of Indian Medical Council Act, 1956 and Section 420 I.P.C., P.S. Jani, District Meeru pending in the court of Judicial Magistrate, 2nd, Meerut vide Criminal case No. 439 of 2004.

From the perusal of the record  and the impugned charge sheet it appears that on the basis of the material collected by the the I.O. prima facie offence is made out and there is sufficient material to proceed further, therefore, the prayer for quashing the charge sheet  is refused.  

Accordingly, this application is dismissed.
