The statement of witness has been recorded.
According to prosecution story, applicant Brijesh Singh and another have came rear the deceased Khushaboo and her sister. The non-applicant Sushil Kumar Patel got the deceased seated in front of cycle and Kr. Gudiya on the rear seat. Gudiya jumped down and narrated the story.
Thus, there is no allegation against the applicant.
Considering this I find it a fit case for bail.
Let applicant Brijesh Singh be released on bail, in Crime No.4/ 2006, under sections 363, 376,302 and 201 I.P.C, Police Station Reoti, District Ballia, on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of Court concerned.
