List on 30th August, 2006. All the respondents may file the counter affidavit on or before 25th August, 2006. Rejoinder may be filed on or before the date fixed. The contention of the petitioner is that the arrears of Teh Bazari dues cannot be realized as arrears of land revenue, for which reliance has been placed on a Division Bench decision of this Court in the case of Mohammad Umar Vs. Collector/District Magistrate reported in 2006 (3) ALJ 561. As an interim measure, it is directed that the recovery proceedings pursuant to the order dated 2nd February, 2006 by way of arrears of land revenue, shall remain stayed.
