Heard learned Counsel for the applicant, learned A.G.A. and Sri R.P. Singh learned counsel for the complaint.

It is contended by the learned counsel for the applicant that according to prosecution version the role of catching hold is assigned to the applicant. The role of causing injuries is assigned to co-accused Intzar. The case of the applicant is distinguishable with the case of co-accused Intzar.

After considering the facts and circumstances of the case and  the submissions made by the learned counsel for the applicant  and without expressing any opinion on the the merits of the case, the applicant is entitled to be released on bail.

Let the applicant  Dilshad involved in Case Crime No. 157  of 2006, under Sections 302/34 I.P.C., Police Station Mussoori, District Ghaziabad  be released on bail on his furnishing a personal bond and two   sureties each of the like amount to the satisfaction of the court concerned.
