This is an application for bail moved on behalf of the applicant Harendra Singh alias Bobby involved in case Crime No. 66 of 2006 under section 364-A I.P.C., Police station Hariparawat, district Agra.

Heard Sri Dinesh Kumar Misra, learned counsel for the applicant, learned AGA and have perused the record.

The learned counsel for the applicant submitted that the applicant was not amongst those co-accused who had gone to the place of co-accused Gulab to call him. The learned counsel argued that co-accused Praveen has been granted bail by an order of this Court dated 23.6.2006 passed in Criminal Misc. Bail Application No. 12007 of 2006. The learned counsel argued that there is no allegation of demand of ransom against the applicant. The learned counsel contended that the abductee in his statement has not mentioned the parentage, and residential address of the applicant nor he was previously known to him.

The learned AGA argued that the applicant and co-accused abducted the doctor from his clinic. The learned counsel urged that the victim was rescued prior to any demand of ransom could be made by the applicant and co-accused.

I have taken into consideration the submissions advanced on behalf of both the parties.

Co-accused Praveen has been granted bail by an order of this Court dated 23.6.2006 and the case of the applicant stands at par with co-accused. In view of these facts, I consider it to be a fit case for bail.

Let the applicant Harendra Singh alias Bobby involved in case Crime No. 66 of 2006 under section 364-A I.P.C., Police station Hariparawat, district Agra, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
