This is second bail application. The Criminal Misc. First Bail application No. 13670 of 2005 has been rejected by this court on 29.9.2005
It is submitted by learned counsel for the applicant that in the present case all the witnesses of the facts including the alleged kidnapped persons have not supported the prosecution story and they have been declared hostile. The statement of Mohd. Ashif P.W. 4 has been recorded in the trial court and he has been cross examined also. He has not supported the prosecution story, therefore, he has been declared hostile.
After considering the statement of P.W. 4 and other witnesses and the other circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Jadish involved in Case Crime No. 380 of 2005, under Section 364-A I.P.C., Police Station Mauranipur , District Jhansi be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
