HIGH COURT OF JUDICATURE OF ALLAHABAD

HON. SHISHIR KUMAR, J.

By means of the present writ petition the petitioners have approached this Court for commanding respondent no.2 to announce the date of counseling for admission in 2 years B.Ed. Course in the University. The petitioners admit that they appeared in the B.Ed. examination conducted by the University and the petitioners were declared pass and were directed to appear in the counseling-vide its letter dated 22.2.2006. Copy of the same has been annexed as annexure to the supplementary affidavit. In pursuance of the aforesaid letter the petitioners on 7.7.2006 went to the University but it has been informed that the counseling has been cancelled. Now there is no information by the respondents that when the counseling will commence. To this effect the petitioners alleged that they have submitted  representations on their behalf as well as on behalf of the other affected candidates but the same have not been considered. Hence, the writ petition.

A counter affidavit on behalf of the respondent University has been filed by Sri Prakash Padia. Sri Padia has annexed a copy of the order dated 25.7.2006 in which on the basis of certain complaints it has been directed that a Committee of three members is being constituted for the purpose of investigating the complaint relating to B.Ed. examination. It has further been submitted on behalf of the respondents that the outcome of the report of the Committee has not yet come.

After hearing counsel for the parties I am of opinion that as the petitioners have already submitted  representations, the same may be considered. It is provided that if the petitioners submit a detailed representation to respondent no.2 within a week annexing copy of the writ petition as well as copy of the supplementary affidavit, the same may be considered by respondent no.2 and respondent no.2 shall pass an appropriate detailed and reasoned order according to law preferably within three weeks from the date of filing of the representation as well as the certified copy of this order before him.

With these observations the writ petition is disposed of.
