This is an  application for bail moved on behalf of the applicant Ram Pratap alias Lali   indicted in case crime No. 58  of  2005 under sections 395, 397, 412  I.P.C. P.S. G.R.P. Firozabad  District Firozabad.

Heard Shri Devendra Kumar, learned counsel for the applicant, learned A.G.A.  and have perused the record.

The learned counsel for the applicant submitted that the name of the applicant was disclosed by the co-accused in his confessional statement. According to learned counsel the applicant was arrested on 15.2.2006 and test identification parade was conducted on 15.4.2006 in which he was identified by a single witness. The learned counsel urged that no recovery of looted property was made from the possession of the applicant.

The learned A.G.A. argued that applicant was identified by a witness Nazani Begum. According to learned counsel applicant and seven co-accused committed dacoity in the running train.

I have taken into consideration the submissions advanced on behalf of both the parties.

The applicant was named by  co-accused in his confessional statement. The applicant was arrested on 15.2.2006. The test identification parade was conducted on 15.4.2006 in which the applicant was identified by a single witness. No recovery of looted property was made from the possession or at the pointing out of the applicant. It being a case of no recovery and single identification, I consider it to be a fit case for bail.  

Let the applicant Ram Pratap alias Lali   indicted in case crime No. 58  of  2005 under sections 395, 397, 412  I.P.C. P.S. G.R.P. Firozabad  District Firozabad, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
