Heard learned A.G.A. for the State appellant and perused the impugned judgment.
The accused respondent is the real brother of the deceased Netra Pal. The identify of the dead body was not mentioned. There is no direct evidence of the murder. The witnesses alleged to have last seen the deceased in the company of the accused respondent, has turned hostile. The trial court appears to have considered all the facts and circumstances while passing the order of acquittal.
Considering the facts and circumstances of the case, we do not find any reason to interfere in the order of acquittal passed by the trial court.
The prayer to grant leave to file the appeal is hereby refused.
