Heard learned counsel for the petitioner Sri Aklank Jain and the learned counsel for the respondents Sri Ranjeet Saxena.

Incase the petitioner deposits a sum of Rs. 91,000/- within two months with respondent no.2, No recovery against the petitioner shall be made. The representation dated 31.6.2005 (Annexure-4 to the writ petition) of the petitioner shall be decided as soon as the sum of Rs.91,000/- is deposited by the petitioner, latest within six weeks thereafter. In case of default, the writ petition shall stand dismissed.

With these observations the writ petition is disposed of.
