Heard learned counsel for the parties.
This petition has been filed for a direction upon the respondents to pay the petitioner all dues i.e. provident fund, gratuity, bonus, medical facilities and also the family pension.
A counter affidavit has been filed on behalf of the respondents. In paragraph 15 of the counter affidavit it has been stated that all the dues are under legal process and the claim of the petitioner is to be decided in view of the fresh evidence collected. This affidavit was filed in the year 1994.
Sri S.K. Verma learned counsel for the petitioner has stated that till date the respondents have not decided the claim of the petitioner.
In this view of the matter, the petition is finally disposed of with a direction that in case the claim of the petitioner has not been decided as yet, the Officer Commanding, Military Hospital, Bareilly respondent no. 1 shall pass an appropriate order within a period of six weeks from the date a certified copy of the order is produced by the petitioner before him.
