Rajvir Singh v. State Of U.P. & Others - CRIMINAL REVISION No. 1770 of 1987 RD-AH 12677 (1 August 2006)
Hon'ble R.K. Rastogi,J.:
List has been revised. None is present either for the revisionist or for O.Ps. no. 2 to 6.
Heard arguments of the learned A.G.A. appearing for the State and perused the record.
This is a revision against the judgment and order dated 2.9.1987 passed by the Addl. Sessions Judge, Mathura in S.T.no. 99 of 1986, State Vs.Tularam and others, under sections 147, 148, 302, 307 and 149 I.P.C. Accused Tularam was convicted under section 302 I.P.C. and accused Bani Singh was convicted under section 307 I.P.C. and the remaining accused were acquitted. Against that acquittal order as well as the acquittal of Bani Singh under section 302 I.P,C. this revision has been filed.
Since Tula Ram was convicted under section 302 I.P.C. and Bani Singh was convicted under section 307 I.P.C., both of them must have filed appeals against their conviction order. Office shall report whether any appeal against conviction order has been passed or not and in case any appeal has been filed, this revision be connected with that appeal and be listed with the same for hearing.
