This is an application for bail moved on behalf of the applicant Ravi Prakash Srivastava involved in case Crime No. 289 of 2005 under section 3/7 of Essential Commodities Act, Police station Soraon, district Allahabad.
Heard Sri Lav Srivastava, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that inspection of premises was not carried out in the presence of the applicant and recovery of gas cylinders was not made in his presence. The learned counsel urged that there is no complaint of any customer about the sale of each gas cylinder for Rs.350/-.
The learned AGA argued that recovery of 15 domestic gas cylinders was made from the rented premises of the applicant.
I have taken into consideration the submissions advanced on behalf of both the parties.
The search of premises of the applicant was taken in his absence. There is no complaint of any customer that gas cylinders were being sold by the applicant for Rs.350/- per cylinder. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Ravi Prakash Srivastava involved in case Crime No. 289 of 2005 under section 3/7 of Essential Commodities Act, Police station Soraon, district Allahabad, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
