This is an application for bail moved on behalf of the applicants Shashank Shekhar Singh alias Dablu Singh and Vishram involved in case Crime No. 224 of 2006 under sections 147, 148, 332, 353, 323, 336, 427, 504, 506 I.P.C., section 7 of Criminal Law Amendment Act and section 3 of Lok Sampati Nivaran Adhiniyam, Police station  Gauri Bazar, district Deoria.

Heard Sri P. C. Srivastava, learned counsel for the applicant, Sri K.N. Mishra, learned counsel for the complainant, learned AGA and have perused the record.

The learned counsel for the applicants submitted that the applicants and 60-70 unknown persons are said to have subjected the injured persons to assault. The learned counsel argued that injuries found on the person of the injured are of simple nature. The learned counsel submitted that no specific role has been assigned to the applicants except that they raised objection to the measurement of land.

The learned counsel for the complainant and learned AGA argued that the applicants and unknown accused persons formed an unlawful assembly with 60-70 persons and subjected the public servants to assault.

I have taken into consideration the submissions advanced on behalf of both the parties.

The applicants and 60-70 unknown persons are said to have subjected the public servants to assault by wielding of lathis and throwing bricks and stones. No specific role has been assigned to the applicants. The injuries inflicted are of simple nature. In view of these facts, I consider it to be a fit case for bail.

Let the applicants Shashank Shekhar Singh alias Dablu Singh and Vishram involved in case Crime No. 224 of 2006 under sections 147, 148, 332,  353, 323, 336, 427, 504, 506 I.P.C., section 7 of Criminal Law Amendment Act and section 3 of Lok Sampati Nivaran Adhiniyam, Police station  Gauri Bazar, district Deoria, be enlarged on bail on their furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
