Pursuant to the order dated 25.7.2006 passed by the Hon'ble The Chief Justice, Civil Misc. (Stay Vacation) Application No. 141316 of 2006 has been placed before me.

Shri B.N. Agrawal, learned counsel for the respondent no.3/applicant in the aforementioned Application states that a Stay Vacation Application, namely, Civil Misc. (Stay Vacation) Application No. 215062 of 2002, filed on behalf of the respondents, is already pending in the present Writ Petition, and in the circumstances, the respondent no.3/applicant in the aforementioned Civil Misc. (Stay Vacation) Application No. 141316 of 2006 does not want to press the said Civil Misc. (Stay Vacation) Application No. 141316 of 2006, and the same may be dismissed as not pressed without prejudice to his right to pursue the said Civil Misc. (Stay Vacation) Application No. 215062 of 2002, already pending in the present Writ Petition.

In view of the statement made by Shri B.N. Agrawal, learned counsel for the respondent no.3/applicant, the aforementioned Civil Misc. (Stay Vacation) Application No. 141316 of 2006 is dismissed as not pressed without prejudice to the right of the respondent no.3/ applicant in Civil Misc. (Stay Vacation) Application No. 141316 of 2006 to pursue the said Civil Misc. (Stay Vacation) Application No. 215062 of 2002, which is already pending in the present Writ Petition.

In view of the dismissal of the aforesaid Civil Misc. (Stay Vacation) Application No. 141316 of 2006 as not pressed, I hereby release the present case.

Let the papers be placed before the Hon'ble The Chief Justice for appropriate orders.
