Heard learned counsel for the parties.
As per the office report dated 17.1.2006, the notices upon the proposed legal representatives of deceased respondent No. 2 being 2/2 and 2/3 have not been served, as the persons of their names are not available in the village. The legal representative No. 2/5 is also not served. The proposed legal representatives of deceased respondent No. 5 have been served sufficiently by the notice. Rest of the proposed legal representatives are duly served.
Steps for service upon the unserved proposed legal representatives be taken within two weeks. Smt. Hemlata Singh puts in appearance on behalf of the proposed legal representative Nos. 2/1 and 5/1. She prays for and is granted two weeks' time to file counter affidavit. Rejoinder affidavit, if any, thereafter be filed within one week. Notices shall be issued after steps have been taken upon the unserved legal representatives returnable within six weeks.
List thereafter on the date fixed in the notice.
