This is an application for bail moved on behalf of the applicant Akram involved in case Crime No. 298 of 2006 under sections 489-B, 489-C, 420, 467, 468, 471 I.P.C., Police station Delari, district Moradabad.

Heard Sri Ramesh Kumar Mishra, learned counsel for the applicant, learned AGA and have perused the record.

The learned counsel for the applicant submitted that  fake currency notes valuing Rs.20,000/- are alleged to have been recovered from the possession of the applicant. The learned counsel argued that co-accused Mohammad Khalil from whom recovery of counter feit currency notes valuing Rs.20,000/- is made has been granted bail by  an order  of this Court dated 12.7.2006 passed in Criminal Misc. Bail Application No. 13665 of 2006.

The learned AGA argued that recovery of fake currency notes valuing Rs.20,000/- was made from the  possession of the applicant.

I have taken into consideration the submissions advanced on behalf of both the parties.

The counter-feit currency notes valuing Rs.20,000/- are said to have been recovered from the possession of the applicant. There are no public witnesses to the recovery. There is no criminal history of the applicant. Co-accused Mohammad Khalil has been granted bail by an order of this Court dated 12.7.2006. In view of these facts, I consider it to be a fit case for bail.

Let the applicant Akram involved in case Crime No. 298 of 2006 under sections 489-B, 489-C, 420, 467, 468, 471 I.P.C., Police station Delari, district Moradabad, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
