Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is named in the F.I.R. There is no direct eye witness account. The applicant has been named only on the basis of the doubt and suspicion, because it is said that the applicant had met with the first informant in a perturbed condition. Co-accused Karan Singh and Brij Bhushan have been released on bail by this court. The case of the applicant is on the same footing with the case of the above mentioned co-accused.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Bachchi alias Raja Ram involved in Case Crime No. 21 of 2006, under Sections 302 and 201 I.P.C., Police Station Muskara , District Hamirpur be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
