This is an application for bail moved on behalf of the applicants Faizan and Sani involved in case Crime No. 71 of 2006 under section 3/5/8 of Cow Slaughter Act, Police station Fatehpur, district Saharanpur.

Heard Sri K.K. Singh, learned counsel for the applicants, learned AGA and have perused the record.

The learned counsel for the applicants submitted that the applicants were not arrested at the spot nor any recovery was made from their possession. The learned counsel urged that co-accused Naushad and Anis were arrested on the spot.

The learned AGA argued that the applicants and co-accused Irfan were cutting the beef at the house of the applicant Sani and recovery of beef, blood in one drum, six skins, six heads of cows and livestock of cows  was made.  

I have taken into consideration the submissions advanced on behalf of both the parties.

The applicants having not been arrested on the spot, I consider it to be a fit case for bail.

Let the applicants Faizan and Sani involved in case Crime No. 71 of 2006 under section 3/5/8 of Cow Slaughter Act, Police station Fatehpur, district Saharanpur, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
