Although the order of the Chancellor is not before us but the letter of the University dated 8th November 2005 is enclosed mentioning reasons for refusing to continue the temporary affiliation to the educational institution of the petitioners.
It does not appear from the record that before passing the impugned order dated 22nd September 2005, the Chancellor has taken into account the various orders of the Court including the order dated 20th October 2005 passed by this Court and the inspection report of the Committee appointed by the Vice-Chancellor of the University dated 19th June 2005 regarding shifting of the institution. In the circumstances, we set-aside the order dated 22nd September 2005 as well as the consequential order of the University dated 8th November 2005 requiring the Chancellor to re-examine the matter as expeditiously as possible, by a reasoned order.
In the meantime, the temporary affiliation granted to the petitioners' institution which already has approval from the N.C.T.E., for B.Ed., course will be deemed to continue till the fresh decision is taken by the Chancellor but not beyond the current academic session i.e. 2005-06.
The writ petition is disposed of after hearing learned counsel for the petitioner, Sri Neeraj Tripathi for the Chancellor and Sri Anurag Khanna for the University.
