Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that in the present case the wife of co-accused Dharmendra has been murdered. During the investigation the evidence of extra judicial confession has been collected by the I.O. and there is a evidence of last seen also. There is no motive or intention for the applicant to commit the alleged offence. The case of the applicant is distinguishable with the case of co-accused Dharmendra.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Om Prakash involved in Case Crime No. 68 of 2006, under Sections 302, 304/ 34 I.P.C. Police Station Sumerpur , District Hamirpur be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
