Heard learned Counsel for the applicant, learned A.G.A. and Sri Ram Krishna Misra learned counsel for the complainant.
It is submitted by learned counsel for the applicant that in the present case there is no direct eye witness account. The evidence against the applicant is that he was seen in the company of the deceased and from his possession one ring of the deceased was recovered whereas some other articles of the deceased were recovered from co-accused Anoop Tiwari, Narendra Verma, Rakesh and Chakresh, who have been released on bail by this court. The case of the applicant is on the same footing with the case of above mentioned co-accused.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Radhey Shyam involved in Case Crime No. 26 of 2005, under Sections 147, 148, 149, 364, 302, 201, 414 and 404 I.P.C., Police Station Kotwali, District Agra be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
