This is an application for bail moved on behalf of the applicant Raj Pal Singh Gadariya involved in case Crime No. 82 of 2006 under sections 401, 411, 413 I.P.C., Police station Sarai Akil, district Kaushambi.
Heard Sri H.K.Sharma, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that recovery of ornaments and narcotic powder weighing 200 gram is said to have been made from the possession of the applicant. The learned counsel argued that the recovered ornaments have not been connected with any case of theft or robbery.
The learned AGA conceded that recoveries made from the possession of the applicant have not been connected with any case of theft or robbery.
I have taken into consideration the submissions advanced on behalf of both the parties.
The recovered ornaments having not been connected with any case of theft or robbery, I consider it to be a fit case for bail.
Let the applicant Raj Pal Singh Gadariya involved in case Crime No. 82 of 2006 under sections 401, 411, 413 I.P.C., Police station Sarai Akil, district Kaushambi, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
