Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is mother-in-law of the deceased. The deceased committed suicide inside the room, which was bolted from inside. The door was broken. Thereafter, the dead body was recovered. The information was given by Umesh Chandra at police station concerned. On that information the inquest report was prepared . At that time the first informant and his father Gauri Shankar and other persons were present there. The father of the deceased Gauri Shankar is witness of the inquest report. He did no make any allegation in respect of demand of dowry. According to post mortem report the cause of death is hanging. The applicant is patient of heart. He is liing separately. He has taken separate gas and electric connection.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Ram Prakash involved in Case Crime No. 376 of 2006, under Section 498-A, 304-B I.P.C. and Section ¾ Dowry Prohibition Act, Police Station Shahganj , District Agra be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
