Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is cousin of the husband of the deceased. He is not named in the F.I.R. There is no allegation against him in respect of demand of dowry and committing cruelty with the deceased. The name of the applicant has been disclosed after one month of the alleged offence. The allegation against him is that at the time of cremation he was scuffling and there is no other evidence against him. His case is distinguishable with the case of other co-accused who are named in the F.I.R.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Bachchi alias Raja Ram involved in Case Crime No. 121 of 2006,under Sections 498-A, 304-Band 201 I.P.C. and Sections ¾ Dowry Prohibition Act, Police Station Bhojpur, District Ghaziabad be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
