The applicant is involved in Case Crime No. 160 of 2006, under Section 18/20 N.D.P.S. Act, Police Station Civil Lines, District Aligarh.
Heard learned counsel for the applicant and learned A.G.A. for the prosecution.
From the recovery memo, it is evident that 600 gm. charas was recovered from the possession of the accused-applicant and the entire contraband as alleged was sealed by the police on the spot and was sent for chemical examination, but report of Chemical Examiner shows that total weight was 100 gm. There is no justification for this difference.
In such circumstances, the applicant is entitled for bail.
Let the applicant Yunus be released on bail on his executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of court concerned.
