List has been revised. The Court has waited for sometime. However, the learned counsel for the parties have not appeared.

The case is listed today for consideration of Civil Misc. (Delay Condonation) Application No. 2007 of 2006 and Civil Misc. (Substitution) Application No. 2008 of 2006.

The aforementioned Applications have been filed consequent to the death of Ram Bali Sahu (plaintiff-appellant).

As none is present for the applicants to press the aforementioned Applications, the Court has no option but to dismiss the aforementioned Applications for want of prosecution.

Accordingly, Civil Misc. (Delay Condonation) Application No. 2007 of 2006 and Civil Misc. (Substitution) Application No. 2008 of 2006 are dismissed for want of prosecution.

As noted above, the aforementioned Applications have been filed consequent to the death of Ram Bali Sahu (plaintiff-appellant).

In view of the dismissal of the aforementioned Applications for want of prosecution, the Second Appeal, at the instance of the said Ram Bali Sahu (plaintiff-appellant), stands abated.

The said Ram Bali Sahu was the sole plaintiff-appellant. Therefore, the Second Appeal stands dismissed as having abated.
