Supplementary affidavit along with correct copy of the F.I.R has been filed.
It is submitted by learned counsel for the applicant that according to prosecution version the role of catching hold is assigned to the applicant whereas the role of firing is assigned to co-accused Ramesh, Pan Singh, Shreepal, Anar Singh. It is further alleged that co-accused Jugnandan Singh caused injuries on the person of the injured.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Budhari involved in Case Crime No. 920 of 2005, under Sections 147, 148, 149, I.P.C. Police Station Gunnaur , District Budaun be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
