Jagdish Prasad And Others v. Ram Kumar And Others - SECOND APPEAL No. 654 of 1983 RD-AH 12982 (4 August 2006)
Hon. S.P. Mehrotra, J.
A perusal of the record shows that S/Shri Ram Ji Saxena and G.M. Saxena are appearing as the learned counsel for the defendants-appellants. However, their names have been incorrectly shown in the Cause List in the column wherein the names of the learned counsel for the respondents are mentioned.
Registry will ensure that the names of S/Shri Ram Ji Saxena and G.M. Saxena are correctly shown as the learned counsel for the defendants-appellants in the Cause List, when the case is listed next.
Perused the Office Report dated 3.8.2006 in regard to service of notice stated to have been issued on Civil Misc. (Substitution) Application No. 2652 of 1984 (dated 17.5.1984) to the defendants-respondents nos. 6 and 7 pursuant to the order dated 3.3.2000 passed by the O.S.D. Enquiry (Vigilance) read with the order dated 3.3.2004 passed by the Court.
In view of the said Office Report dated 3.8.2006, let fresh notices be issued by Registered Post A.D. to the defendants-respondents nos. 6 and 7. Notices will be issued fixing 22.12.2006.
Steps will be taken by the learned counsel for the defendants-appellants within six weeks, failing which, the case will be listed before the Court under Chapter XII, Rule 4 of the Rules of the Court immediately on the expiry of the said period.
List on 22.12.2006.
