The petitioner has approached this Court by means of this writ petition being aggrieved by an order passed by the Board of Revenue dated 7th November 2005 whereby the revision filed by the petitioner against the order dated 19th February 2001 passed by the Pargana Adhikari has been dismissed.
The orders impugned in the present writ petition are the orders whereby the parent order of the Tahsildar was held to be in accordance with law by which he has allowed restoration application and directed the matter to be heard on merit after giving opportunity to the applicant for restoration.
Learned counsel for the petitioner has expressed his apprehension that in view of the discussion in the order impugned in the present writ petition, which according to him, would be binding on the Tahsildar when hearing the matter. Needless to say this apprehension is baseless. The matter will be heard and decided on merits.
In view of what has been stated above the writ petition has no force and is accordingly dismissed.
