This is an application for bail moved on behalf of the applicant Ajai Yadav indicted in case crime No. 449 of 2006 under section 25 Arms Act, P.S. Sikandra District Agra.
Heard Shri M.K. Mishra, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that co-accused Ankit Vashistha from whom recovery of illicit weapons was made, has been enlarged on bail. The learned counsel argued that there are no public witnesses to the recovery and there is no criminal background of the applicant.
The learned A.G.A. argued that recovery of two pistols of .32 bore was made from the possession of the applicant.
I have taken into consideration the submissions Advanced on behalf of both the parties.
There are no public witnesses to the recovery. The offence is triable by the Magistrate Ist class. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Ajai Yadav indicted in case crime No. 449 of 2006 under section 25 Arms Act, P.S. Sikandra District Agra , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
