Standing counsel represents respondent nos. 1 to 3. He prays for and is granted six weeks time to file counter affidavit. The petitioner will have three weeks thereafter to file rejoinder affidavit. List thereafter.
Until further orders the operation of the impugned order dated 14.9.2005 of the Commissioner, Moradabad Mandal, Moradabad and order dated 29.5.2004 of the Additional District Magistrate (Finance & Revenue), Moradabad shall remain stayed, provided the petitioner deposits within a period of six weeks from today half of the amount payable under the impugned order before the Additional District Magistrate (Finance & Revenue), Moradabad. In case of default, the interim order shall stand automatically vacated. Any amount already deposited by the petitioner in pursuance of the impugned orders shall be adjusted. However, if the petitioner has deposited more than half of the amount payable under the impugned orders, the same shall remain in deposit and shall be subject to the result of the writ petition.
