Amrish v. State Of U.P. - CRIMINAL MISC. BAIL APPLICATION No. 16050 of 2006 RD-AH 13060 (7 August 2006)
Hon'ble (Mrs.) Saroj Bala,J.
This is an application for bail moved on behalf of the applicant Amrish indicted in case crime No. 486 of 2006 under section 2/3 U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986 P.S Singhanee Gate District Ghaziabad.
Heard Dr. Hridyawati Mishra, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that two cases have been shown against the applicant in the gang chart and applicant is on bail in both the cases.
The learned A.G.A. argued that applicant is a habitual offender and in case he is enlarged on bail, he will commit other offences of similar nature.
I have taken into consideration the submissions advanced on behalf of both the parties.
The applicant having been enlarged on bail in both the cases shown in the gang chart, I consider it to be a fit case for bail.
Let the applicant Amrish indicted in case crime No. 486 of 2006 under section 2/3 U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986 P.S Singhanee Gate District Ghaziabad, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
