This is an  application for bail moved on behalf of the applicant Mahboob Alam   indicted in case crime No. 404  of 2005  under sections 460, 411  I.P.C. P.S.  Bidhanu District Kanpur Nagar. Heard Shri Vinod Kumar Srivastava, learned counsel for the applicant, learned A.G.A.  and have perused the record.

The learned counsel for the applicant submitted that applicant is not named in the First Information Report and his name came to light from the confessional statement of co-accused Ranjeet, who has been enlarged on bail by an order dated 23.6.2006 of this court passed in Criminal Misc. Bail Application No.12056 of 2006.

The learned A.G.A. argued that applicant absconded after his name was disclosed by the co-accused. The process under section 82/83 Cr.P.c. was issued against him and his movable properties were attached.

I have taken into consideration the submissions advanced on behalf of both the parties.

The applicant is not named in the First Information Report and his name came to light from the confessional statement of  co-accused Ranjeet. The applicant was not put up for  identification . In view of these facts, I consider it to be a fit case for bail.  

Let the applicant Mahboob Alam   indicted in case crime No. 404 of 2005  under sections 460, 411  I.P.C. P.S.  Bidhanu District Kanpur Nagar , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
