Notice on behalf of the opposite party no. 7 has been accepted by Shri Pramod Jain and notice on behalf of the respondent no. 8 has been accepted by Shri Tarun Verma, Advocate. Let notice be sent to respondent nos. 5 and 6 fixing 25th September, 2006. Steps to be taken within a week. All the respondents may file counter affidavit on or before 11th September, 2006. Rejoinder affidavit, if any, may be filed on or before the date fixed.
The contention of the petitioner is that the Catholic Diocese of Meerut is running an institution in the name of St. Marry Academy at Saharanpur of which house tax has been exempted by the State Government.
As an interim measure, it is provided that the arrears of house tax and current house tax pursuant to the citation dated 13th July, 2006 filed as Annexure 5 to this writ petition shall remain stayed. If the Bank account has been ceased in respect of the demand of arrears of house tax, the attachment shall be lifted.
It is made clear that the Court has not stayed the demand of water tax and other taxes.
