One Ram Swarup @ Sarupa had taken loan from Syndicate Bank. He could not pay the same and his property was auctioned on 7.8.89. In this auction Respondent No. 5 to 8 are the auction purchaser. According to the petitioner these proceedings have not become final and objection against the auction is still pending before Board of Revenue in a revision. In the meantime, the Bank has filed a suit for recovery of amount and suit was decreed on 7.4.2004. According to the petitioner entire dues has been paid. Thereafter the petitioner purchased the property from Ram Swarup on 7.2.2006. Now a sale deed dated 15.6.2006 has been executed by the S.D.M. in favour of respondent nos. 5 to 8 in pursuance of the auction held on 7.8.89. Hence, the present writ petition.
We have heard learned counsel for petitioner, learned standing counsel and Sri Sanjeev Singh for respondents.
The auction sale has not been set aside. The matter is still pending before the Board of Revenue. It is appropriate that the petitioner should approach the Board of Revenue for the proper orders.
In view of this, the writ petition is dismissed at this stage.
