Heard learned Counsel for the applicant, learned A.G.A.
It is submitted by learned counsel for the applicant that according to prosecution version the alleged occurrence has taken place on 22.3.2006 at 9.00 p.m. Its F.I.R. was lodged on 23.3.2006 at 6.30 a.m. The F.I.R. was lodged by the wife of the deceased. According to the F.I.R. the injuries were caused by the applicant and co-accused Mewa Lal, but according to the post mortem examination report the deceased has received on gunshot wound of entry.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Chandra Dev Tewari involved in Case Crime No. 35 of 2006, under Sections 302 and 120-B I.P.C., Police Station Khakheru, District Fatehpur be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
