Heard learned Counsel for the applicant, learned A.G.A.
It is submitted by learned counsel for the applicant that according to prosecution version the applicant and 3 other co-accused persons caused injuries by using lathi, danda and brick blows. Consequently, the deceased received injuries and the first informant also received injuries. Co-accused Pramod Kumar and Mithilesh Kumar have been released on bail by this court on 4.7.2006 in criminal misc bail application no. 11728 of 2006. The case of the applicant is on the same footing with the above mentioned co-accused persons.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Kedar Yadav involved in Case Crime No. 374 of 2005, under Sections 308, 323, 325, 504, and 506 I.P.C., Police Station Jahanganj, District azamgarh be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
