It is submitted by learned counsel for the applicant that according to prosecution version the role of catching hold is assigned to the applicant and the role of exhortation is assigned to co-accused Faujdar Yadav. It is said that co-accused Ram Shabd Yadav has caused injuries on the person of deceased. The case of the applicant is distinguishable with the case of Ram Shabd Yadav. Co-accused Faujdar Yadav has been released on bail on 24.7.2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Lal Mayan Yadav involved in Case Crime No. 277 of 2006,under Sections 302 and 506 I.P.C. and Section 7 Criminal Law Amendment Act, Police Station Sidhari, District Azamgarh be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
