Heard learned counsel for the petitioners.
The petitioners, by means of this writ petition, have prayed for the following reliefs:-
(a) a writ, order or direction in the nature of mandamus direction the respondents to mutate the name of petitioner in the revenue record of the land in question after cancelling the present entries in the revenue record. In pursuance of the order dated 4.2.2004 passed by Additional Commissioner Agra, Division Agra.
(b) Any other suitable writ, order or direction which this Hon'ble Court may deem fit and proper in the circumstances of the present case.
(c) Award cost of it to be paid the petitioner.
A perusal of the annexures annexed along with the writ petition clearly demonstrates that after the order was passed by the appellate authority, namely the Commissioner concerned, it is not stated that as to whether any second appeal is filed before the Board of Revenue or not. The petitioners approached the Collector after the order of the Commissioner, directing the names of the petitioners to be mutated over the land in question, was passed. It has not been stated that what proceedings are pending before Collector and also as to whether there is any stay order from any Court or authority.
In this view of the mater the petition at this stage is premature and is liable to be dismissed and is hereby dismissed.
