It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. During investigation two witnesses disclosed the name of the applicant. According to their statements no active role has been assigned to the applicant. Co-accused Abdul Mateen, whose case is on the same footing with the case of the applicant, has been released on bail on 10.5.2006 in criminal misc bail application no. 9254 of 2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Vikash Singh Chauhan involved in Case Crime No. 336 of 2005, under Sections 302, 394, 120-B and 411 I.P.C., Police Station Bhelupur, District Varanasi be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
