It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. He has not been put up for identification. The only allegation against him is that two dolors have been recovered from his possession, but the dolors have not been shown in the F.I.R. as a looted property. The other co-accused persons have been released on bail by this court.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Rajendra Nishad involved in Case Crime No. 185 of 2005 under Sections 396 and 412I.P.C, Police Station Fatehabad, District Agra be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
