The controversy raised in this petition is squarely covered by the decision of the Apex Court in Civil Appeal No. 3686 of 2003, Jai Prakash and others Vs. State of U.P. and others, decided on 14.9.2004,  reported in (2004) 13 SCC 390, wherein it has been held that the liability for payment of additional tax is also on those vehicles which are not covered by any permit.

The writ petition is, accordingly, dismissed.
