Admittedly against the order impugned in the present writ petition, an efficacious statutory alternative remedy by way of Appeal under Rule 11 of the U.P. Government Servant (Discipline and Appeal) Rules, 1999 has been provided for.
The present writ petition is accordingly dismissed on the ground of availability of statutory alternative remedy.
However in the facts and circumstances of the case it is provided that in case the petitioner files an Appeal under Rule 11 of the aforesaid rules within three weeks from today along with a certified copy of this order, the same shall be entertained by the Appellate Authority, without raising any objections with regard to delay, if any, in filing of the same.
The Appellate Authority shall endeavour to consider and decide the appeal to be filed by the petitioner in accordance with law, by means of a reasoned speaking order, preferably within six weeks.
