The contention of the petitioner is that the property in question is not situated within the municipal limits of Nagar Panchyat, Jansath, and therefore, she is not liable to pay the house tax as demanded. She has already made a representation on 18.1.2006 before the respondent no. 1, which is said to be still pending.
Taking into consideration the entire facts and circumstances of the case, the writ petition is disposed of with the direction to the respondent no. 1 to pass appropriate orders in accordance with law on the aforesaid representation of 18th January, 2006 within a period of one month from the date a certified copy of this order along with the copy of the said representation is filed before him. For a period of six weeks or till the representation is decided, whichever is earlier, the recovery of the impugned amount shall remain stayed.
It is made clear that the Court has not adjudicated the claim on merits.
