Heard learned counsel for the applicants and learned A.G.A.
This application is filed by the applicant against the order dated 5.10.2005 passed by the learned C.J.M., Shahjahanpur whereby the objection filed by the applicant in Criminal Case No. 5507 of 2002 was rejected. It is contended by the learned counsel for the applicant that the impugned order was passed in absence of the applicant without affording opportunity of being heard to the applicant and the NBW has been issued against the applicant. The impugned order is illegal . In case the impugned order is not recalled the applicant shall suffer for irreparable loss.
Considering the facts and circumstances of the case and submissions made by the learned counsel for the applicant it is directed that in case the applicant appears before the court concerned within 20 days from today and furnishes his personal bond and the learned Magistrate shall accept the same and pass a fresh order on the objection filed by the applicant.
With the above direction the application is finally disposed of.
