Shri M.M. Sahai, Advocate states that he has filed a fresh Vakalatnama on behalf of the plaintiffs-appellants nos. 1 to 5 alongwith Civil Misc. (Substitution) Application No. 139320 of 2006 and Civil Misc. (Delay Condonation) Application No. 139321 of 2006 filed on behalf of the plaintiffs-appellants nos. 1 to 5.
A perusal of the record shows that the said Vakalatnama is appended to the aforementioned Applications.
Issue notice on the aforementioned Applications. Notices will be issued to the defendants-respondents by Registered Post A.D. fixing 10.1.2007.
Steps will be taken by the learned counsel for the plaintiffs-appellants nos. 1 to 5 (applicants in the aforementioned Applications) within eight weeks, failing which, the case will be listed before the Court under Chapter XII, Rule 4 of the Rules of the Court immediately on the expiry of the said period.
Shri M.M. Sahai, learned counsel for the plaintiffs-appellants nos. 1 to 5 further informs the Court that copies of the aforementioned Applications were sent by his Office to Shri Krishna Swarup, Advocate, who was appearing as the learned counsel for the defendants-respondents nos. 2,4,7,8,9 and 10 by Registered Post. The said Registered Post, Shri Sahai states, has been received back unserved with the endorsement that the said Shri Krishna Swarup, Advocate has expired.
In view of the above, let notices be issued to the defendants-respondents nos. 2,4,7,8,9 and 10 to engage another Counsel. Notices will be issued fixing 10.1.2007.
