Heard learned Counsel for the applicant, learned A.G.A. and Sri S.N. Singh learned counsel for the complainant.
It is submitted by learned counsel for the applicant that according to prosecution version the applicant and 5 other co-accused persons were shown armed with Pharsa and on person was shown armed with lathi. According to post mortem examination report the deceased has received 11 injuries in which only 2 injuries were incised wounds. Co-accuse Mausam and Lifakat have been released on bail by this court. The case of the applicant is on the same footing with the case of the above mentioned co-accused.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Tasavvur involved in Case Crime No. 26 of 2006 under Sections 147, 148, 302 I.P.C, Police Station Sikhera, District Muzaffarnagar be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
